Transfer of the Lease

Mr Grant’s Lawyer asks Mr Casimatis to obtain instructions from Mr Voukelatos on whether they would be prepared to either transfer or surrender the Lease with a new Lease.

“Our client has requested that you obtain the landlord’s instructions as to whether they would be prepared to either have transfer of that lease or surrender of lease with a new lease being granted to Advanced Building Services Australia Pty Ltd.”

Mr Casimatis thinks that Mr Voukelatos may be better off negotiating the surrender of the existing Lease and not to have any more dealing with the Lessee, though it will probably mean that the he will have to attend to the wall and possibly at a higher cost. He also states that he has no confidence that the Lessee will be the Owner’s fairy godmother and resolve all of his issues.

I have no idea why he wants this. Maybe Luke knows?

If you prepared to consider this you will need to satisfy yourself to the credit worthiness of Advanced Building Services Australia Pty Ltd. Maybe Luke can assist here as well.

I am not sure where Luke is up in relation to the wall. On recollection Luke received an incomplete Contract from Jack Grant and Luke was going to get him to complete same for your/mine consideration. I do not know if Jack Grant complied with it. I have no idea where this Jack Grant is coming from. I think you may be better off negotiating a surrender of the existing Lease and not having any more dealing with Jack Grant/Advanced Building Services Australia Pty Ltd. This though will probably mean you will have to attend to the wall and possibly at a higher cost. On the other side of the coin you have been waiting for Jack for some…am aware nothing has happened and what guarantees do you have he will do it properly.

If he has not been paying rent to date this is maybe another reason why you should get rid of him. In summery, I have no confidence that Jack Grant will be your fairy godmother and resolve all of your issues for you. I suspect he will be the wicked witch where you will continually have problems with him. This maybe an opportunity again to broach with him the possibility of surrendering the existing lease and doing away with him.”
